Common Assault
Applying force to another person (touching, striking, spitting, pushing etc) without their consent. Includes making gestures that threatens violence. Dealt within the Magistrates Court and carried a maximum penalty of 3 years imprisonment. Serious Assault
Applies when the assault targets police officers, public officers, or individuals over 60, among others. Maximum penalty: 7 years imprisonment, which can increase to 14 years if involving biting, spitting, or applying bodily fluids to police. Police may elect to have the matter go to the District Court. Assault Occasioning Bodily Harm
Defined as an assault that causes injuries interfering with health or comfort of the victim, such as cuts, grazes, bruises, scratches, etc. The charge carries a maximum penalty of 7 years, increasing to 10 years if armed with a weapon or in company with other offenders. May be dealt with in the Magistrates or District Court. Grievous Bodily Harm
An assault involving permanent physical injury that is intentionally or recklessly caused. It can include disfigurement or wounds that require extensive treatment, such as broken bones, severe lacerations, disfigurement, loss of body parts or organs. The offence carries a maximum penalty of 14 years imprisonment and is dealt with in the District Court. Sexual Assault
Non-consensual indecent touching, such as in a sexual way, or for sexual gratification. Sexual Assaults may also include unwanted sexualised speech or threats of sexual contact, and encouraging or coercing others perform or watch an indent act. This crime carries a maximum penalty of 10 years imprisonment. |
