Valeston Lawyers is happy assist law firms unable to attend a court appearances due to conflicting obligations. We can cover for adjournment or simple mentions to minor contestable appearances in a range of courts.  

We publish 3 weeks of court availability below. Please contact us for special requests or to check if any dates are open.

*You must ensure your client's antecedence and any supporting documents are supplied at least 24 hours prior to the appearance.

​**Notice To Appear matters where bail is refused: We will contact the solicitor with carriage for instructions prior to proceeding. Bail application, brief plea or deferral plea are additional charges.

***Mention 1 & 2 may be completed free if the practitioner is attending to Duty Lawyer services on the day required.

*All pre-mention Practice Direction forms must be complete and sent to the court by you prior to the mention. Delays caused because this is not done will incur a per unit fee.

RATES: DV MATTERS

1: Simple Instructions: 

(DV1) Police Application: $250
(DV2) Private Application: $350​

• Adjournment mention, not contesting a TPO or conditions,
  
• A pre-agreed Undertaking to sign and file with court.
  
• A Consent Without Admissions by the Respondent, not contesting conditions.
• A Withdrawal by the Aggrieved,
• Seek trial directions only.

2: Advanced Instructions:

(DV3) Professional fee $500.00 p/h
includes travel time and parking.

• Contesting the making of a TPO
• Negotiating with OP or Prosecutor for
  • Making an undertaking
  • Conditions to TPO or Final Protection Order
  • Withdrawing an application
• Includes review of materials, on-the-day conferences with OP and Client, and confirming instructions.

To assist in negotiations or advanced instructions, please provide a copy of any existing orders, draft undertakings or orders or other items you think  as applicable.

CONDITIONS & CHARGES

CONDITIONS:

• Rates shown exclude GST.
• A results report will be returned within 24 hours. Let us know if the matter is urgent.
• You will be invoiced on completion of the work in accordance with the rates on this page unless you have otherwise entered into an ongoing agreement.
• Payment terms are strictly 7 days.
• We will attempt to call you if there is a material change or divergence from your written instructions before proceeding with your matter.
• Valeston Pty Ltd, trading as Valeston Lawyers takes no liability for any loss or damages to your firm or your client as a result of undertaking work as instructed on your behalf. Where forensic judgement of the Valeston Lawyers legal practitioner is required to intervene on instructions that do not comply with practice directions or legislation, or conflicts with the stated instructions of the client or conflicts with orders or instructions from the court, work will cease and you (the principal) will be notified in writing for the decision. Professional fees may be charged in such cases.

CHARGES:

• ​$50 per unit surcharge if there are unforeseen delays (e.g. late client attendance, delayed video, incomplete practice direction requirements, incorrect instructions).
• $100 if an interpreter is required for the client
• $100 for inner regional locations - Sunshine Coast, Gold Coast, Ipswich, and Toowoomba.
